Recently, there have been two major changes that impact representation and advocacy of youth in delinquency and bindover cases. First, the Ohio Supreme Court adopted a new rule of procedure, Juvenile Rule 3, which changes access to counsel, including new provisions requiring consultations or court advisement on the dangers of self-representation. Second, on September 28, 2012, the provisions of Ohio Senate Bill 337 (SB 337) went into effect. This bill was designed to reduce collateral consequences for individuals involved in the justice system and included several youth-specific provisions around background checks, detention credit, juvenile record sealing and expungement, and the placement of youth in adult jails. This webcast is designed for all Ohio attorneys who represent youth in the juvenile and adult court. Faculty will provide an overview of Juvenile Rule 3 and SB 337. Significant time will be allocated to discussing the intent of the provisions, implementation of these provisions to date, relevant case law for consideration, implications for practice, and responding to questions from participants.
